Acceptance of User License Agreement
360 Cash websites are licensed
not sold. When you purchase the 360 Cash
Turnkey Business Kit,
the VR BAR Company grants you a non-exclusive
license to use a 360 Cash website template. The
360 Cash Turnkey
Business Kit includes 1-year domain
registration and 1-year of website hosting. You
are not obligated to use the free 1-year hosting
plan with us. Should you choose to host a
website elsewhere, you forfeit your rights to
the use of one of our website templates. It is
your responsibility to either renew your 1-year
of hosting with 360 Cash or obtain hosting
elsewhere prior to the anniversary date of your
purchase. Your domain name becomes your
property. After your 1 year of hosting, should
you elect to continue hosting your website with
us, we will renew your domain registration for
you. If you do not renew your hosting with us,
it is your responsibility to renew your domain
name.
License Grant
You agree that you will not assign,
sublicense, transfer, lease, rent or share your
rights under this License Agreement. You may not
alter, modify, reverse engineer, decompile or
disassemble the templates outside of editing
your personal content.
Domain Name Usage and Ownership
Although we purchase your domain name on your
behalf, you will be and remain the legal
owner/registrant of it. Upon publishing your
website, it may take up to forty-eight hours for
your website to be viewable online. This is out
of our control and due to the global domain
registry. No discounts will be given if you want
to use a domain name that you already own with
the website you host with 360 Cash. No discounts
will be given if you choose to not use a 360
Cash website template. No discounts will be
given if you choose to not host your Virtual
Tour website with 360 Cash.
Copyright
Your initial purchase of the 360 Cash
Turnkey Business Kit
includes the use of images and Virtual Tours
that 360 Cash owns the copyright to. The
copyright of these images and objects are
retained by 360 Cash. You are granted the use of
these images and objects only while you are
entitled to the use of 360 Cash website
templates and 360 Cash website hosting. This
license does not permit you to use these images
and objects outside of your account with us nor
does it grant you ownership or copyright to any
of these images or objects.
Website Content
360 Cash does not control the content of any
user's account and does not have any obligation
to monitor such content for any purpose. All
content provided by a user of 360 Cash
service(s) is the sole responsibility of that
user. 360 Cash will not power any website that
contains pornographic, offensive, or unlawful
material. Upon discovery of such material, 360
Cash reserves the right to remove the material
and terminate your use of 360 Cash website
templates.
User
Responsibility
It is your responsibility to retain originals of
any photos, graphics and Virtual Tours that you
email, upload or FTP to 360 Cash. Virtual Tours,
photos and graphics created by you and posted on
your behalf by 360 Cash are your property. In
many instances, 360 Cash templates and websites
will not contain original photo quality
specifications but versions of the original
photos at a lesser quality. Once the photos are
uploaded, they cannot be reproduced back into
their original state.
Your
Conduct
You must have the legal right to display each
image that you upload. As a condition of the use
of this service, you shall not upload, post or
otherwise transmit any content that is unlawful,
harmful, threatening, harassing, defamatory,
obscene, vulgar, invasive to another's privacy,
hateful or otherwise objectionable; upload,
post, email or otherwise transmit any content
that you do not have the right to transmit under
any law or any content that infringes any
trademark, trade secret, copyright or other
property rights of any party; harm minors in any
way including, but not limited to, content that
violates federal and state child pornography
laws, child exploitation laws and laws
prohibiting the depiction of minors engaged in
sexual conduct.
Limitation of Liability
You expressly agree that the use of 360 Cash is
at your sole risk. 360 Cash templates are
provided on an "as is" and "as available" basis.
360 Cash expressly disclaims all warranties of
any kind, express or implied, including any
claims or promises of how profitable your
business can be. 360 Cash will provide support
and resources to assist you but as with
any business, you determine your own success.
Occasional service outages may occur that 360
Cash cannot control. If such outages occur, 360
Cash will work on restoring services as soon as
possible. 360 Cash will not be liable to you for
any indirect, special, consequential, incidental
or exemplary damages, whether foreseeable or
not, which may result from the unavailability or
malfunction of a 360 Cash website and/or related
service(s). In no event will 360 Cash or its
suppliers have any liability for unauthorized
access to, theft or destruction of any content
made available for distribution by the plan(s)
through fraud or devices.
You
understand and agree that the submission of
digital images to 360 Cash and the download
and/or upload of any material through a 360 Cash
service is done at your own discretion and risk
and that you will be solely responsible for any
loss or damage to your image(s), and any loss or
damage to your computer system or loss of data
that may result in the download of any material.
You are solely responsible for creating back-ups
of your digital images. You acknowledge and
agree that 360 Cash accepts no responsibility or
liability for, and employs no control over, the
content of the information passing through 360
Cash host servers, network hubs or the Internet.
All services hereunder are performed "as is" and
without warranty against failure of performance
including, without limiting to, any failure due
to computer hardware or communication systems.
Except as expressly provided in this Agreement,
360 Cash does not make and hereby disclaims, and
you hereby waive all reliance on, any
representations or warranties, arising by law or
otherwise, in reference to 360 Cash service(s),
including but without limiting to, implied
warranties of merchantability, fitness for a
particular purpose, non-infringement, or
developing from course of dealing, course
of performance, or usage in trade. |
